This article, which is the first of two topics on this topic, describes some issues that need to be considered when entering into an agency agreement that will maximize the officer`s chances of obtaining a commission on the work done. Often, in our practice, clients come to us when the agency agreement has not been notified in accordance with Section 55 and there is a question of entitle to the commission, because the agreement is not technically applicable. Agents are generally paid by commission on the basis of gross income collected for the amount of capital. The agreement should specify how the commission should be calculated, as well as the date and method of payment. Does the officer still have a commission if you receive work without his help? Even after the end of the agency relationship, an agent is not allowed to use confidential information obtained under the Agency in competition with the client or to the detriment of the client. Seek better payment terms – employers generally benefit from changing standard payment terms in an agency`s agreement. Some changes are to be taken into account: within the European Union, there is legislation designed to provide some protection for agents, including the right to compensation in certain circumstances when an agency is terminated. The same is true in other parts of the world, and in some countries it is necessary for a foreign manufacturer to designate as an agent a person or company that is a national of the country in which the Agency will operate.
The same goes for all types of business. The safety of the good deal should be at the forefront of consultation with an agreement. You want to make sure that the agreement you make or ask of an interested party is a correct picture of the agreement reached, legally binding, fair and, above all, applicable.
